How we handle your personal data

This notice sets out how Gilead Sciences, Inc., 333 Lakeside Drive, Foster City, CA 94404, USA, (“Gilead”, “we” or “us”), handles your personal data.

Gilead Sciences Inc. has appointed its affiliates Gilead Sciences Ireland UC, with registered address at, IDA Business & Technology Park, Carrigtohill, Co. Cork in Ireland as its data protection representative in the EU, and Gilead Sciences Ltd, with registered address at 280 High Holborn, London, WC1V 7EE in the UK, as its data protection representative in the UK.

Information we collect.

Gilead collects personal data provided by you, including your full name, address, telephone number, e-mail address, practising certificate details, main place of practice, work experience and employment history, countries or regions where you have lived, worked or studied, information about your race and gender.

Purposes.

We may use your personal data for the following purposes: to grant you access to the portal, identify you as a health care professional validate your credentials, communicate with you. Where applicable, we may also use your personal data to assess your application to the Research Scholarship Programme, to make logistical arrangements on your behalf, provide certain financial support to enable you to participate in the Research Scholarship Programme (known as Award); comply with local laws, regulations and codes of practice on disclosure of details of transfers of value made, directly or indirectly, to healthcare professionals and healthcare organisations (known as Transparency Requirements) in relation to the provision of an Award (and transfers of value may include travel, accommodation, or food and drink provided or reimbursed as part of the Award); and marketing and business development activity. Where you have provided information about your race and/or gender, we will use it only for internal monitoring and improvements of strategies for the realisation of equality in research.

Where the law allows us, we will undertake due diligence checks, such as reputational checks, prior to assigning an Award, in order to protect Gilead from any possible financial risks, legal implications and reputational damages.

We may also process and share statistics based on an aggregation of personal data, provided that no individual is identified from that.

Grounds for use.

We rely on one or more of the following legal bases to process your personal data: to perform our obligations under a contract; to comply with a legal or regulatory requirement; where it is in our or another person’s legitimate interest (and your rights do not override this); and otherwise with your consent.

Sharing with others.

We share your personal data with: other Gilead companies in our corporate group; or other companies such as booking agencies, hotels, transportation companies, so that logistical arrangements can be made on your behalf (if applicable); and third party vendors and suppliers which provide specialized services, such as translation services, and our IT suppliers, who are bound by duties of confidentiality.

Security and retention.

We take steps to ensure that your personal data is subject to appropriate security measures. We maintain servers and other storage facilities in the United States, EU and Asia. Where we transfer your personal data outside the UK/EU or your country, we will ensure that it is protected and transferred in a manner consistent with applicable data protection law.

We keep your personal data for a limited period, sufficient to fulfil the purpose(s) specified in this Privacy Notice, and to comply with our legal requirements, after which it will be deleted. Retention periods are determined on the basis of applicable laws and our business requirements.

Photography.

We may take photographs of the awardees for use in our corporate websites for the purpose of highlighting successful research proposals to other potential applicants, and may appoint a nominated third party (such as an agency or photographer) to do this.

Your choices and rights.

Depending on applicable law, you may have a number of legal rights concerning the personal information that we hold about you. These rights may include: obtaining information about our processing of your personal data, accessing personal data we hold about you, correcting or erasing your personal data and complaining to a regulatory authority about how your personal data is handled.

You also have the right to withdraw your consent where we are relying on your consent to process your personal data.

If you withdraw your consent, Gilead may continue to process your personal data in order to produce disclosures of aggregate statistics relating to transfers of value, from which you cannot be personally identified.
